Learned Government Pleader for Revenue takes notice on behalf of respondent Nos.1 to 6.
Learned counsel for the petitioner is permitted to take out personal notice on respondent Nos.7 to 11 by registered post with acknowledgment due and file proof of service in the Registry.
Sri Srinivas Ambati, learned counsel for the petitioner submits that the appeal filed by respondent Nos.7 to 11 under Section 5B of Andhra Pradesh Rights in Land and Pattadhar Passbooks Act, 1971, per se, is not maintainable in view of the judgment in Ratnamma v/s Revenue Divisional Officer, Dharmavaram, Anantapur District and Others reported in 2015 6 ALD 609.
A perusal of the appeal filed by the unofficial respondents would disclose that the unofficial respondents are seeking to set aside Contd... the entries in web land revenue records, pattadar
passbooks and title deeds pertaining to entries as per ROR Act, 1971 and pass necessary speaking orders in respect of land in Sy.No.1092 of Surabhi Revenue Village, Chakrayapeta Mandal, YSR Kadapa District.
In the light of the prayer sought for by the unofficial respondents whether the RDO got any jurisdiction particularly in the light of judgment referred to supra need to be examined.
List the matter on 05.01.2024.
Till such time, respondent No.5 shall not proceed with the adjudication of the review Appeal No.H/592 of 2019.
