JUDGMENT:

1. When the matter is taken up for hearing in the morning session,

none appeared for the appellant and respondent and the matter

is passed over till 02.15 PM.

2. Even when the matter is taken up in the afternoon session at

02.15 PM also, none appeared for the appellant. Despite the

matter listed under the caption for dismissal, the appellant is

not getting ready. It seems that the appellant has not shown any

interest to prosecute the appeal.

3. Hence, the appeal is dismissed for default without costs.

4. Miscellaneous petitions pending, if any, in this appeal shall

stand closed.
