This application is filed by the petitioner/appellant No.1/

Accused No.2 seeking his release on bail for a limited period in

order to attend the 11th day death ceremony of his father who

died on 02-10-2022.

The petitioner along with other accused were tried by the

Judge, Family Court-cum-IX Additional District and Sessions

Judge, Rajamahendravaram in S.C.No.389 of 2013. After

completion of trial, the petitioner and other accused were

convicted for the offences punishable under Sections 302, 201,

380, 411 r/w.34 IPC and were sentenced to various

imprisonments including the imprisonment for life. The

judgment was pronounced on 22.01.2019. Immediately, the

petitioner was taken into custody and now he is languishing in

Central Jail, Rajamahendravaram.

It is submitted by the learned counsel for the petitioner that

his father died on 02.10.2022. The obsequies of his father have

to be performed on 12.10.2022 at his native village. To support

his contention, he annexed a certificate issued by the Village

Revenue Officer stating that the petitioner is the eldest son of

deceased-K.Rama Rao.

On the other hand, the learned Public Prosecutor confirms

the death of the father of the petitioner.

In that view of the matter, this court is inclined to grant

interim bail to the petitioner for a period of five (5) days.

The Superintendent, Central Prison, Rajahmahendravaram is

directed to release the petitioner on bail for a period of five

days i.e., from 10-10-2022 to 14-10-2022 on his executing a

personal bond for an amount of Rs.10,000/- (Rupees Ten

Thousand only) with one(1) surety to his satisfaction.

The petitioner is directed to surrender before the

Superintendent, Central Prison, Rajahmahendravaram before

5.00 P.M on 15-10-2022.

Accordingly, with the above direction, this application is

ordered.
