There is no representation on behalf the leaned counsel for the respondent No.1/writ petitioner.
As per the material on record, the writ petitioner has not participated in the auction for the Notification F.No.05/KAS/AUC/NLR/2016-DM/S, dated 07.07.2021. He is not aggrieved party.
Learned counsel for the appellant also further stated that the judgment relied upon by the learned counsel for the writ petitioner is not applicable to the present facts of the case.
Hence, this Court inclined to grant an interim order. There shall be an interim suspension of the impugned order dated 05.05.2022 passed in W.P.No.28921 of 2021, on condition of payment of the entire balance amount within a period of one week from today; failing which, the interim order stands vacated and the appellant has to forfeit the entire amount in favour of lessor of the property, which is already deposited with 3rd respondent.
Post this matter after Summer Vacation, 2022.
