The petitioner, who is sole accused in C.C.No.489 of 2013 on the file of the Additional Junior Civil Judge cum I Additional Judicial Magistrate of First Class, Macherla, Guntur District, was convicted for the offence punishable under Section 304-A of IPC and was sentenced to undergo rigorous imprisonment for a period of one year and to pay a fine of Rs.100/- and in default, to undergo simple imprisonment for one month. Appeal preferred against the said judgment was dismissed confirming the said conviction. However, the sentence of imprisonment is reduced from one year to six months.

Aggrieved thereby, the present criminal revision case is preferred.

The petitioner has paid the fine amount in the trial Court. He was also on bail throughout in the trial Court and also in the appeal at the appellate stage.

Therefore, in the said facts and circumstances of the case, this petition is allowed and only the execution of substantive sentence of imprisonment imposed against the petitioner/accused in C.C.No.489 of 2013 on the file of the Additional Junior Civil Judge cum I Additional Judicial Magistrate of First Class, Macherla, which in turn was confirmed in Crl. Appeal No.214 of 2018 on the file of the X Additional District and Sessions Judge, Gurazala, is hereby ordered to be suspended till the disposal of this criminal revision case.

The petitioner/accused shall be released on bail on executing a self bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned Additional Junior Civil Judge cum I Additional Judicial Magistrate of First Class, Macherla.
