ORDER:-
The wife of the petitioner No.1 herein preferred a D.V.C
against the respondents before the Court of II Additional Junior
Civil Judge, Tenali. The Court below by order dated 13.06.2012 in
D.V.C.No.15 of 2010 has dismissed the same.
2. Aggrieved by the said judgment, the wife of the petitioner
No.1 herein filed an appeal before the Court of learned Sessions
Judge, Guntur in Criminal Appeal No.229 of 2012. The lower
appellate Court Judge after considering the evidence elaborately,
allowed the appeal and granted a monetary relief of Rs.500/-
(Rupees Five hundred only) per month in addition to the enhanced
maintenance, to the wife payable by the petitioner No.1 herein
from the date of complaint.
3. Heard learned counsel for the petitioners.
4. A perusal of the material record shows that there is no
dispute with regard to the relationship between the petitioner No.1
and the respondent No.1 as husband and wife respectively.
5. In view of the facts and circumstances of the case, I find no
reason to interfere with the order passed by the lower appellate
Court as the amount awarded is only Rs.500/-(Rupees Five
hundred only) per month, in addition to the enhanced
maintenance in C.R.P.No.147 of 2009 which has become final.
6. Accordingly, the Criminal Revision Case is dismissed.
7. Miscellaneous Petitions pending, if any, shall stand closed.
