We have heard Mr. Ancha Panduranga Rao, learned counsel appearing on behalf of the applicant/accused and Mr. S. Dushyanth Reddy, learned Additional Public Prosecutor, for the State.
2. This case has been assigned to Mr. Ancha Panduranga Rao, through Legal Aid Committee.
3. The application has been moved on behalf of the sole accused seeking suspension of sentence and for his enlargement on bail.
4. Learned Additional Public Prosecutor has drawn the attention of the Court to the dying declaration and the relevant portions of the Judgment to state that the deponent is in a fit state of mind, as certified by the Medical Officer, to confirm the evidentiary value of the dying declaration.
5. This Court has considered the documents on record. The finding of the trial Court is based on the dying declaration coupled with the circumstantial evidence. Considering the manner in which the crime has been committed coupled with the
reasoning given by the trial Court, this Court, for the present, is not inclined to show any indulgence to the applicant/convict and therefore rejects the application for suspension of sentence and for grant of bail.
6. This Court puts on record the sincere efforts and the assistance rendered by learned counsel for the appellant, who is assigned by the Legal Aid Committee, to persuade the Court in setting his client free.
