Learned counsel for the petitioner submits that
disproportionate assets case is pending against the
petitioner and that he was retired from service on
attaining the age of superannuation on 31.10.2016;
he further submits that certain terminal benefits
have to be paid to him i.e., family benefit fund,
APGIS, GPF and APGLI. He also submits that further
amount has to be paid to him towards encashment
of earned leave and no disciplinary proceedings are
pending against the petitioner. He relies upon the
judgment of the Division Bench of this Court in WA
No.196 of 2022.
As seen from G.O.Rt.No.1097 Finance Department
dated 22.06.2000,family benefit fund, APGIS, GPF
and APGLI have to be paid, as no recovery can be
effected under the above said heads.
In view of the same, respondents 1 to 3 are
directed to consider payment of the said amounts i.e., family benefit fund, APGIS, GPF and APGLI to the petitioner as expeditiously as possible.
Other payments which are allegedly due to the petitioner will be considered after the counter- affidavit is filed.
List the matter after eight (8) weeks.
