The contention of the petitioners is that the
respondents are trying to establish burial ground in
Survey No. 202-4 to an extent of Ac.3.40 cents, Sy.No.253-2 to an extent of Ac.0.32 Cents, Sy.No.389-2 to an extent of Ac.10.00 Cents situated in Arthamuru Village, Mandapeta Mandal Konaseema District.
Learned counsel for the petitioners submitted that this High Court has decided the issue in various judgments that without changing the classification of the land, the respondents are not entitled to assign the land for burial ground.
A perusal of the material placed on record clearly discloses that the subject land is classified as Cheruvu.
In view of the above facts and circumstances of the case, the respondents are directed not to assign the subject land for Burial Ground without classification of the land.
Post this case after four weeks. Learned Government Pleader to file counter in the meanwhile.
