This petition is filed to grant time for a period of three weeks i.e. 15.06.2022 to deposit the 1/3rd of the decretal amount along with costs of the suit.
In I.A.No.1 of 2022, on 08.02.2022,this Court granted stay of all further proceedings pursuant to the impugned judgment and decree subject to the condition of the petitioner depositing 1/3rd of the decretal amount along with costs of the suit, within a period of twelve weeks from the date of the order and later vide orders in I.A.No.1 of 2022, on 14.03.2022 an amendment was carried out in the order dated 08.02.2022 by incorporating the number 'XI' instead of '1' and subsequently amended vide orders dated 15.06.2022 in I.A.No.2 of 2022 by changing the suit number from O.S.No.124 of 2014 to O.S.No.52 of 2017 and vide the same orders further period of three weeks was granted for compliance of the earlier direction.
Even then, now, the petitioner seeks three more weeks to comply the direction on the ground that he could not comply the orders as the copy of the order was made ready on 20.06.2022 and the petitioner could not contact the advocate as he was suffering from viral fever and later he could not deposit the amount only one day was left to comply the direction.
In the circumstances pleaded by the petitioner, time as sought for is granted for three (3) weeks from 18.07.2022.
Accordingly, the petition is allowed.
