JUDGMENT:-

     The present Civil Miscellaneous Appeal is filed aggrieved

by the Order dated 13.04.2007 passed in I.A. No.856 of 2007

in O.S. No.68 of 2007, on the file of the II Additional District

Judge, Guntur.


2.   The application was filed under Order 39 rules 1 & 2

CPC restraining the respondents from screening the film title

Bommarillu, in which interim suspension granted in favour of

the petitioner/plaintiff against the respondents/defendants in

the suit. The same was challenged by way of Civil

Miscellaneous Appeal before this Court.

3. Learned Senior Counsel for the respondents herein has

submitted that the O.S. No.68 of 2007 was decreed and

against the same an appeal was filed in A.S. No.1025 of 2012

which is pending.

4. Hence, the present Civil Miscellaneous Appeal is

dismissed as infructuous.

Miscellaneous Petitions pending, if any, shall stands

closed.
