JUDGMENT:-
No representation for the petitioner.
The petitioner has filed the present writ petition for a
direction particularly one in the nature of writ of mandamus
declaring the action of the respondents in retiring the petitioners at
the age of 58 years is illegal, arbitrary and unconstitutional and in
violation of Articles 14, 16 and 21 of the Constitution of India as
also in violation of Act 4 dated 27.06.2014 and with further prayer
that the respondents be directed to continue the petitioners till the
age of 60 years.
There is no interim order in favour of the petitioner in the
present writ petition.
Ms. K.L.Vijaya Lakshmi, learned counsel for the respondent
No.3/the Bank submits that the respondent No.3 is an
autonomous body and it did not enhance the age of
superannuation from 58 to 60 years and consequently, the
petitioner was rightly retired on attaining the age of 60 years. She
submits that the writ petition has been rendered infructuous.
Be that as it may, as the learned counsel for the petitioners
is not present, the writ petition is dismissed for want of
prosecution.
Accordingly, the Writ Petition is dismissed.
No order as to costs.
As a sequel thereto, miscellaneous petitions, if any pending,
shall also stand closed.
