Learned counsel for the petitioner is permitted to take out notice to the 5th respondent through RPAD and file proof of service into Registry.

The case of the petitioner is that he is working as Superintendent in the office of the Deputy Director (TW), Paderu since 2018; impugned proceedings dated 21.06.2022 were issued posting him from the office of the Deputy Director (TW), Paderu, to the post of Deputy Statistical Officer, Office of the Project Officer, ITDA, on deputation citing it as administration grounds; 5th respondent is transferred vis-a-vis from the post of Deputy Statistical Officer, Office of the Project Officer, ITDA, in the place of the petitioner; proceedings were served on 30.06.2022 A.N.; petitioner has completed three (03) years of services in the said station; petitioner never worked as Statistical Officer; G.O.Ms.No.116, Finance (HR.I-PLG. & POLIC) Department, dated 07.06.2022, does not permit such deputations; consent of the employee is must for sending an employee on deputation in view of the Judgment of the Apex Court in State of Punjab Vs., Indersingh [(1997)8 SCC 372] and in similar circumstances, an interim order SL. DATE ORDER OFFICE NO. NOTE was passed by this Court in W.P.No.20147 of 2021 on 13.09.2021.

As seen from the impugned proceedings, dated 21.06.2022, petitioner was posted on deputation as Deputy Statistical Officer on administrative grounds. As the consent is necessary to send an employee on deputation in accordance with F.R.110(a), there shall be an interim order as prayed for.

Post the matter on 19.07.29022 for filing counter.
