                      and     learned      Government        Pleader      for
                      respondents.

The grievance of the petitioner in Interlocutory Application is that the petitioner is not being allowed to travel out station for the purpose of his cloth business on the ground that the rowdy sheet is opened against the petitioner and is still pending.

Learned Government Pleader for Home has got the written instructions. Copy of the same is kept in the file which shows that there are number of cases pending against the petitioner and the existence of rowdy sheet is also not denied. There are no clear averments in the instructions about the issues raised in the writ petition. In view of the judgment of Hon'ble Supreme Court in the case of K.S.Puttaswamy and another v. Union of India and others 1the right to life has been held to include the current issue also. The right to conduct his occupation is also a guaranteed right. In view of the authoritative pronouncements of Hon'ble Supreme Court judgment, there cannot be a restriction from the movement of the petitioner for his legitimate cloth business only on the ground that there is a rowdy sheet pending or continuing against the petitioner.

In view of the above, there shall be a

(2017) 10 SCC 1

direction in IA.No.1 of 2022 restraining the respondent Nos.4 and 5 not to interfere in the petitioner's legitimate business or to preventing him for travelling outstation, in case he is going out on his legitimate business.
