                       ORAL JUDGMENT

Mr. J. Sudheer, learned Amicus Curiae, submits that

unfortunately the petitioner, who was appearing in person and

was present in Court on 12.11.2021, passed away on 16.11.2021.

It was submitted that a tragic incident occurred as on the

information of neighbours, the authorities broke open the door of

petitioner's house where she was found in unconscious state and

even after being admitted to hospital on 15.11.2021, she could

not survive and finally passed away on 16.11.2021.

2. Ms. Sumathi, learned Government Pleader, Services-

II, submits that the respondent no.3 had personally visited the

petitioner in the morning on 15.11.2021 for getting the papers

signed, but there was lack of cooperation. However, it was

submitted that in the evening she was informed that the

petitioner was not responding and when she went there, with the

help of the police the door was broken and she was found in an

unconscious state and taken to hospital where she passed away

the next day.

3. Having regard to the aforesaid, the Court can only

comment that it is a sad state of affairs that a person, who has

worked for the State, was not paid her pensionary benefits and

died in unfortunate circumstances, may be due to lack of money

to meet her daily expenses including food and medical.

4. Learned Amicus Curiae further informed that the

relatives had come to see the body in the mortuary on 18.11.2021

but as they were not ready to perform the last rites, a charitable

trust did the same on 18.11.2021.

5. In the aforesaid background, the Court finds that

nothing remains in the present writ petition and accordingly, the

same stands disposed of. There shall be no order as to costs.

6. In view of submissions of learned Amicus Curiae, the

Court would observe that the State is required to be sensitive and

vigilant with regard to timely payment of pensionary dues to its

employees for the simple reason that upon superannuation

suddenly the employee is left with no other means of livelihood

except for his/her pensionary benefits on a much lower amount

and also there being no logistical support as was being enjoyed by

the employee, when in service.

7. The Court, thus, would request the learned

Government Pleader to forward a copy of this order to the Chief

Secretary for being circulated to all the departments so that

pensionary dues are paid, at least to the extent admitted, to the

employees without any delay so that such tragic incident does not

occur leading to any person suffering for lack of monetary

support.

8. Miscellaneous petitions, if any pending, also stand

disposed of.
