Heard both sides and perused the record. Though Sri M.R.S.Srinivas, learned counsel for the petitioner/appellant, submits that this is a case where an interim order has to be granted on the ground that there are altercations in the pronote, which are not attested by any signature but Sri V.Nageswara Rao, learned counsel for the respondent, submits that in view of the fact that the appeal came to be filed with a delay, at least 20% of the decretal amount may be directed to be deposited.
Having regard to the submissions made by the learned counsel for the respondent, there shall be interim stay of all further proceedings pursuant to the judgment and decree, dated 19.11.2018, passed in O.S.No.156 of 2014 on the file of the learned X Additional District Judge, Tirupati, on condition of the petitioner/appellant depositing 20% of the decretal amount along with costs within a period of eight (8) weeks from today, in default, the stay shall stand vacated automatically. On such deposit, the respondent/plaintiff is at liberty to withdraw the same without furnishing any security.
