CRIMINAL PETITION No.2313 OF 2021
ORDER:
The petitioners are accused No.1 and 2 in Cr.No.123 of
2021 in Tadipathri Rural Police Station, Ananthapur District
under Section 332 read with 34 IPC.
2. Sri Goalla Seshadri, learned counsel for the petitioners
would submit that the allegations made against the accused are
false statements. He would submit that as far as accused No.2
is concerned, the said accused was practising law and was
present in the office of the senior in Ananthapur Town. In the
circumstances, he submits that the complaint itself is a false
complaint and submits that the complaint itself is quashed. He
also submits that accused No.2 has already granted anticipatory
bail in the matter.
3. A perusal of the complaint reveals allegations which
require further investigation.
4. In the circumstances, this Criminal Petition is disposed of
with a direction to the investigating officer to complete the
investigation in accordance with law and after giving benefit of
Section 41-A Cr.P.C to the petitioners as set down in the
guidelines of the Hon'ble Supreme Court in the judgment of the
Arnesh Kumar vs. State of Bihar1
(2014) 8 SCC 273
Consequently, miscellaneous petitions, if any, pending shall stand closed.
