2. Heard Sri Farhan Khan, learned counsel for the petitioner and Sri Mahabir Singh, learned counsel for the opposite party nos. 1 and 2 and perused the material on record.

3. The present petition under Article 227 of the Constitution of India has been filed by the petitioner- Mohd. Dani, with the prayer to set aside the impugned order dated 01.12.2025 passed by J.M. Court No.2, Ballia in Application No. UP04615 dated 21.11.2025 and allow the application dated 21.11.2025 filed by the petitioner.

The submission of learned counsel for the petitioner is that although the Court of the Judicial Magistrate, Court No.2 Ballia has vide order dated 01.12.2025 rejected the application for grant of NOC to the petitioner but on the ground that the said application has been filed by Mohd. Farooq the brother of the petitioner. It is submitted that the petitioner now intends to file a proper application before the court concerned in compliance of order dated 17.11.2025 passed by a Division Bench of this Court in Writ C No. 39973 of 2025 (Mohd. Dani Vs. Union of India and 3 others) which may be directed to be decided by the court concerned expeditiously.

5. Needless to state, that the application for NOC has been rejected on the ground that the same has been filed by Mohd. Farooq the brother of the petitioner and thus the petitioner may move a fresh application for the same which is expected to be decided by the court concerned in accordance with law after hearing the parties.

6. The petition stands disposed of with the aforesaid directions.
