HON'BLE MANISH KUMAR NIGAM, J.
1. This petition has been filed challenging an order passed in execution proceedings.
2. A suit instituted against the petitioner was decreed by the trial court and the appeal filed by the petitioner was dismissed in default. The application for restoration of appeal filed by the petitioner under Order XLI Rule 19 of C.P.C. was also rejected. The petitioner preferred First Appeal From Order against the order rejecting the application under Order XLI Rule 19 of C.P.C, which has been admitted by this Court on 28.04.2025.
3. Since the matter is pending before the appellate court, the petitioner may move an appropriate application for grant of interim relief as claimed by him before this Court.
4. In view of the same, I am not inclined to interfere in the matter.
5. Accordingly, the petition is disposed of with liberty to the petitioner to pursue the remedy as available to him under the law.
