Sri Arvind Prabodh Dubey, learned counsel for the applicant and Sri R.K. Singh, learned A.G.A. for the State are present.

The present application under Section 528 of B.N.S.S. has been filed to quash the order dated 8.11.2023, whereby Principal Judge, Family Court, Maharajganj, dismissed the application for giving opportunity of hearing of the case which is arising out under Section 125 of Cr.P.C.

Learned counsel for the applicant fairly admits that at the time of hearing of application in question the case had been fixed for ex-parte judgment.

After some arguments, learned counsel for the applicant does not want to press the present application.

In view of above, the present application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.

Certified copies of the relevant documents be returned to learned counsel for the applicants after retaining a photocopy of the same.
