Supplementary affidavit, filed today, is taken on record.
I have heard learned counsel for the petitioner and perused the material on record.
The writ petition has been filed assailing the order dated 03.07.2024 and 31.05.2024 passed in execution proceedings initiated in the year 2011. As the order impugned dated 03.07.2024 only relates to the issuance of attachment order against the judgment debtor and the next date was fixed for 11.07.2024, the writ petition has practically been infructuous as subsequent order passed by the Executing Court has not been challenged in the present writ petition.
Learned counsel appearing for the petitioner has fairly submitted that the subsequent order passed by the Executing Court is under challenge in the different writ petitions. He also submits that an amount of Rs.48,000/-, pursuant to the attachment order, has also been deposited by the judgment debtor before the Court concerned.
In view of the said facts, writ petition has become infructuous and same stands dismissed.
