Heard learned Counsel for the parties.

The present application seeks withdrawal of first appeal filed by the appellant, namely-Alok Mishra. The application for withdrawal is taken on record.

Shri Yashovardhan Swarup, learned Counsel for the appellant submits that the appellant has challenged the judgment dated 23.08.2022 in Regular Suit No.325 of 2017 (Old No.341/2015) Shradha Shandiyayan vs. Alok Mishra filed under Section 9 of the Hindu Marriage Act. He further submits that the appellant through common acquaintances has come to know that the respondent has remarried while the appellant was in Lucknow Jail in connection of CBI Case No.RC 21822022A0009 CBI/ACIII/New Delhi under Section 7, 7A and 8 of Prevention of Corruption Act and Section 120-B I.P.C. and now the appellants wants to move on with his life as such in the circumstances the appellant does not want to pursue this appeal any further.

Learned Counsel for the respondent has no objection to the prayer made by learned Counsel for the appellant.

In view thereof, the present application is allowed as a result the First Appeal No.82 of 2022 is consigned to record as withdrawn.
