Heard Shri Shailendra Singh, learned Counsel for the applicant, Shri Ashok Kumar Srivastava, learned A.G.A. for the State-opposite party and perused the material placed on record.

At the outset, learned A.G.A. for the State-opposite party made a preliminary objection regarding the maintainability of the present application under Section 482 Cr.P.C. as the applicant has an alternate remedy under Section 256 read with Section 302 Cr.P.C. to approach competent forum for redressal of his grievance and also in light of the judgment of the Hon'ble Supreme Court in the case of Chand Devi Daga and Others vs. Manju K. Humatani and Others reported in (2018) 1 SCC 71.

Learned Counsel for the applicant also made an agreement with the submissions of learned A.G.A. for the State-opposite party and submits that he does not want to press this application on merits and wants to withdraw the same with liberty to approach the competent forum in accordance with law.

In view of the above, the present application is hereby dismissed as withdrawn with liberty as prayed by learned Counsel for the applicant.

Office is directed to return all the certified copies annexed with this application to learned Counsel for the applicant after keeping a photostat copy of the same on record.
