Applicants-Appellants, namely, Ramesh Joshi and Banti Joshi have applied for suspension of sentence during pendency of the appeal, arising against the judgment of conviction and order of sentence dated 30.09.2023 passed by Special Judge, S.C./S.T. (P.A.) Act, Jhansi in Special Trial No. 01 of 2007, thereby convicting the appellants under Sections 323/34, 325/34, 504, 506 I.P.C. and Section 3(1)10 Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, followed by imposition of sentence of seven years, under Section 325/34 I.P.C. with fine of Rs.5,000/-; three years, under Section 3(1)10 Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 with fine of Rs.3,000/-; two years, under Section 504 I.P.C. with fine of Rs.2,000/-, two years, under Section 506 I.P.C. with fine of Rs.2,000/- and one year, under Section 323/34 I.P.C. with fine of Rs. 1,000/-, with a further condition that in the event of non deposit of fine(s), convict shall undergo further imprisonment of three months, two months, one month, one month and 15 days, respectively.
After arguing for some time, learned counsel for appellants does not press this application and prays for withdrawal.
The prayer is not opposed by learned A.G.A.
The application is dismissed as withdrawn.
