1. Heard Sri Prabhakar Awasthi, learned counsel for the applicant and Sri B.P.Singh, learned A.G.A.
2. This anticipatory bail application has been filed to grant anticipatory bail to the applicant in Case Crime No.0532 of 2020 under Sections 420, 409, 120B, 411, 34 I.P.C. and 9,10 of U.P. Public Examination Act, 1998, Section 66 of Information & Technology (Amendment) Act 2008 and Section 7 (ka), 8, 9,12, 13 (2) of Prevention of Corruption Act, Police Station-Rohaniya, District- Varanasi.
3. Learned counsel for the applicant after arguing for sometime fairly submits that applicant will surrender before learned Trial Court in connection with F.I.R. No.532 of 2020 registered at Police Station-Rohaniya, Varanasi, Uttar Pradesh dated 20.12.2020 within ten days and will file regular bail application on the same day and further prays that after surrender of applicant, bail application so filed may be decided preferably on the same day on the basis of judgment passed by Supreme Court on the principles of law on bail.
4. Learned A.G.A. has no objection against aforesaid submission.
5. In the aforesaid circumstances without entering into the merits of the case, taking note of statement made at bar and on the basis of instructions, this anticipatory bail application is disposed of with a direction that in case applicant surrenders before learned Trial Court within ten days from today, and thereafter files a bail application, same may be considered preferably on the same day taking note of judgement passed by Supreme Court on the issue of law on bail.
