Heard learned counsel for petitioner; Ms. Priyanka Singh, learned counsel holding brief of Shri Namit Sharma, learned counsel appearing for respondent and learned Standing Counsel for the State.

The issue raised in the present petition is similar to the one decided by this Court in Writ - A No.13327 of 2020 vide judgment dated 10.04.2023.

Thus, on the similar ground and analogy as contained in the judgment dated 10.04.2023, the present writ petition is allowed.

Impugned order dated 01.09.2018 is set aside.

The benefits given to the petitioners of Writ - A No.13327 of 2020 vide judgment dated 10.04.2023 shall enure in the case of the petitioner also.
