Heard learned counsel for the parties.
This petition has been filed seeking following main relief:-
"(I) Issue a writ, order or direction in the nature of certiorari to quash the judgment and order dated 05.01.2016 passed by opposite party no. 1 in revision no. 681 of 2015 (Smt. Omwati Vs. Smt. Savitri Devi and others)."
During pendency of this petition, the parties had entered into a compromise after settling their dispute outside the Court amicably. Considering the same, this Court on 02.03.2023 passed the following order:-
"I.A. No.4 of 2023 - Application for amendment in the memo of writ petition and I.A. No.5 of 2023 - Application for disposal of amendment application
Considering the avernment made in the affidavit filed in support of the amendment application and as also that the parties to the litigation have entered into the compromise.
No objection has been filed to the same.
Application is allowed.
Learned counsel for the petitioner is permitted to carry out the necessary amendment within seven working day.
List this case before Senior Registrar of this Court on 17.03.2023 for verification of the compromise deed.
Parties to the litigation shall appear before the Senior Registrar, High Court Lucknow on the date fixed i.e. 17.03.2023.
Let the matter be again listed before this Court on 23.03.2023 along with mediation report.
Application for disposal of amendment application stands disposed of."
In compliance of the order of this Court dated 02.03.2023, the Senior Registrar of this Court has submitted a report dated 17.03.2023, which being on record reads as under:-
"Vide Hon'ble Court's order dated 02-03-2023, parties were directed to appear before the undersigned today for verification of compromise deed dated 04-08-2022, which is annexed as Annexure No. A-1 to C. M. Application No IA/3/23.
Today, petitioner Savitri Devi D/o Shri Shiv Ratan Lal and wife of Late Ram Shankar alongwith her learned counsel Shri Ram Lakhan Vishwakarma, Advocate and respondent no.2 Omwati Devi D/o Shri Shiv Ratan and wife of Shri Ram Saran alongwith her learned counsel Shri Vishnu Srivastava, Advocate are present before me. Vakalatnama of both the counsels are on record. The proof of identity i.e. Aadhar Card is produced by both the parties, at the time of verification.
The contents of said compromise deed have been read over and explained to both the parties to the compromise deed and they have stated that they have executed the same according to their free will and as a token there of they have affixed their photographs, put R.T.Is. and signatures, which are duly attested and verified by their respective counsels.
In view of the said facts, the compromise between petitioner Savitri Devi D/o Shri Shiv Ratan Lal and wife of Late Ram Shankar and respondent no.2 Omwati Devi D/o Shri Shiv Ratan and wife of Shri Ram Saran is being verified by me today i.e. 17th day of March, 2023.
The report is submitted before Hon'ble Court for orders."
In view of above, this petition is disposed of in terms of the compromise entered into between the parties, which shall form part of this order.
