Heard learned Counsel for the applicant and learned A.G.A. for the State/respondent as well as perused the record.
The present anticipatory bail application has been filed by the applicant apprehending his arrest in Case Crime No.0380 of 2017 under Section 406, 419, 420, 467, 468, 471 I.P.C., Police Station Dargah Sharif, District Bahraich.
Notice to respondent no.2 is disapensed with.
Learned counsel for the petitioner, after arguing the matter for some time, submits that he does not want to press this application for anticipatory bail and seeks liberty to file a regular bail application in the light of judgment of Hon'ble Supreme Court in Aman Preet Singh versus C.B.I. through Director passed in Criminal appeal No.929 of 2021.
Learned A.G.A. has no objection in case applicant's bail application may be decided by the trial court in the light of the judgment in Aman Preet Singh's case (supra).
In view of the above, the application for anticipatory bail is dismissed as not pressed. However liberty is given to the applicant to move regular bail application before the learned trial court within fifteen days' from today, which shall be decided expeditiously in view of the judgment of Hon'ble Supreme Court in the case of Aman Preet Singh (supra).
