None present on behalf of the appellant to press this appeal nor any slip for passing over or adjournment has been sent.
Having regard to the averments made in the application seeking condonation of delay, we find that the delay has sufficiently been explained.
Accordingly, application for condonation of delay is allowed. Delay, if any, in filing appeal is hereby condoned.
Order on memo of appeal:
This special appeal challenges judgment and order dated 20.04.2005, passed by learned Single Judge in Writ Petition No.509 (M/S) of 2003, whereby writ petition filed by the petitioner-appellant has been dismissed.
The prayer made by the appellant-petitioner in the writ petition was that she be declared to have passed her examination conducted by U.P. Madhyamik Shiksha Parishad.
Learned Single Judge on perusal of the original record which was produced before him has given a finding that even on scrutiny the appellant-petitioner was found to have failed in the examination and in the scrutiny no change in marks awarded to her in Science-II paper was found.
In view of above, we see no reason to interfere in the order passed by learned Single Judge. The special appeal is hereby dismissed.
