Shri Om Shiv, learned counsel for the applicant and Shri Ramesh Kumar Singh, learned AGA for the State are present.
The present transfer application has been filed by the victim of the case to transfer the Sessions Trial No. 17 of 2018 (State of U.P. Vs. Suresh and Others) under Sections 147, 302, 504, 506 of IPC, Police Station Shivli, District Kanpur Dehat, pending in the Court of Sessions Judge, Kanpur Dehat to any other adjoining District.
Learned counsel for the applicant submits that the present sessions trial is pending for the argument since 22.07.2022 and the case was listed for judgment on 19.11.2022, after that on 17.12.2022, an application on behalf of the defense was moved and after that on 23.12.2022, the remaining argument was heard and again listed on 07.01.2023 for judgment. After that the case was again listed for remaining arguments for several dates.
In view of the above facts and circumstances, the transfer application deserves no merit and dismissed.
However, the case is pending for arguments since 22.07.2022 and the trial has not been concluded till today. The trial court concluded the present sessions trial expeditiously without giving any unnecessary adjournment to the parties.
Learned Sessions Judge is directed to monitor the status of the present Sessions Trial No. 17 of 2018.
Accordingly, the present application is dismissed.
