1. Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal. Sri Ram Prakash Shukla, learned counsel for the State is present.

2. The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 6.8.1988 by Addl. Sessions Judge, Banda in S.T. No.153 of 1986.

3. As per the office report dated 29.4.2023, a report of C.J.M., Banda dated 18.2.2022 has been received stating therein that the sole appellant Surendra @ Lala Nai has died around three years back. The said report has been sent after due inquiry.

4. This Court has perused the said report which states that the accused-appellant has died.

5. In view of the above, the appeal stands abated.

6. File consigned to records.

7. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
