3. Sri Bade Lal Bind, learned State counsel is present, who has been heard.

4. The present appeal has been filed by the appellant Nanhu against the judgment and order dated 22.03.2006 passed by IInd ADJ/FTC, Budaun in Sessions Trial No. 604 of 1996, Police Station Gunnaur, District Budaun.

5. As per office report dated 07.07.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 19.06.2023 informed that the appellant - Nanhu has died nine years ago. In support of which a report of concerned police station and the copy of the statements of the family and other witnesses have also been annexed thereto.

6. Accordingly, the appeal stands abated.

7. Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
