1. Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

2. This application under Section 482 Cr.P.C. has been filed to quash the impugned judgment and order dated 3.4.2023 passed in Case No.1874 pf 2023, under Section 125 Cr.P.C., Police Station-Fatehpur, District- Saharanpur, pending before the Principal Judge, Family Court, Saharanpur.

3. Learned counsel for the applicant submitted that interim maintenance granted by trial court is excessive whereas the evidence is yet to come. Applicant is a labourer and is not in a position to pay the maintenance amount awarded by the trial court.

4. Considering the arguments raised by applicant's counsel, it is hereby directed that the applicant shall pay the amount Rs.1,500/- p.m. to his wife as maintenance and the amount paid to his son will be same as it was awarded by the trial court. Applicant shall pay the amount regularly as per direction issued by order dated 03.04.2023. In default, the order passed by this Court shall stand vacated. The trial court is further directed to decide the petition within a period of six months without granting any unnecessary or long adjournments to either of the parties from the date of production of a certified copy of this order, if there is no other legal impediment.

5. With the aforesaid direction, the application is accordingly, disposed off.
