3. Sri Virendra Pratap Singh, learned State counsel is present, who has been heard.

4. The present appeal has been filed by the appellant Khuddi against the judgment and order dated 30.03.2006 passed by the learned Additional District and Session Judge, Fast Track Court No.3, Ghazipur in Session Trial No. 291 of 2004 (State Vs. Bhusi and others), Police Station Nandganj, District Ghazipur.

5. As per office report dated 05.07.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 30.05.2023 informed that the appellant - Khuddi has died on 25.11.2014. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan as well as Shamshan Ghat, Chochakpur and the copy of the statements of the other witnesses have also been annexed thereto.

6. Accordingly, the appeal stands abated.

7. Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
