Heard learned counsel for the applicant and learned A.G.A. for the State of U.P.

This transfer application has been filed with a prayer to transfer the S.T. No. 174 of 2017 and S.T. No. 175 of 2017 (State vs. Kuldeep @ Gudda and others), under Sections 302, 307, 504 IPC and 25/27 Arms Act, P.S. Achhalda, District Auraiya, pending in the Court of Additional District Judge/ F.T.C. First, Auraiya, to any other court.

Main submission is that trial has been concluded and argument of this case has been started. Applicant is informant of that case. After argument of the case, the judgment was reserved.

Considering the submission of learned counsel for the applicant, in the interest of justice, the transfer application is hereby allowed. S.T. No. 174 of 2017 and S.T. No. 175 of 2017 (State vs. Kuldeep @ Gudda and others), under Sections 302, 307, 504 IPC and 25/27 Arms Act, Act, P.S. Achhalda, District Auraiya, pending in the Court of Additional District Judge/ F.T.C. First, Auraiya is transferred from the court of Additional District Judge/ F.T.C. First, Auraiya to the court of Special Judge SC/ST Act, Auraiya for disposal according to law.

The court shall make endavour to dispose of the said case within two months from the date of receipt of the order.

The transfer application is accordingly, allowed.

Copy of this order be sent to the Court of Additional District Judge/ F.T.C. First, Auraiya and Special Judge SC/ST Act, Auraiya, for compliance through Sessions Judge, Auraiya.
