This is an application for condonation of delay in filing review petition. The application is supported with an affidavit. There is no objection on behalf of opposite parties.

The ground taken in the affidavit is sufficient.

Accordingly, the application is allowed. The delay in filing the review petition is condoned.

Order on review petition:-

Present review petition is filed by petitioner for review of judgment and order dated 31.07.2015 passed in Writ Petition No.979 (S/S) of 1995; 'Shiv Kumar Tewari Vs. State of U.P. and Others'.

Learned counsel for review petitioner submits that grievance of the petitioner in the aforesaid writ petition is with regard to joining and, hence, petition has not become infructuous.

Learned Standing Counsel has no objection to the review petition.

Cause shown is sufficient.

The review petition is allowed.

The order dated 31.07.2015 passed in Writ Petition No.979 (S/S) of 1995 'Shiv Kumar Tewari Vs. State of U.P. and Others' is recalled. The writ petition is restored to its original number.

List the Writ Petition No.979 (S/S) of 1995 before appropriate Court as early as possible.
