This appeal has been filed against judgment and order dated 16.11.1989, passed by IVth Additional District and Sessions Judge, Aligarh, in Sessions Trial No.389 of 1984, wherein the accused appellant has been convicted and sentenced under Section 302, 307 IPC. The maximum sentence awarded to him is life imprisonment.
A letter has been received from the Chief Judicial Magistrate, Aligarh, stating that the appellant no.1 Manohar has died on 25.12.2022. Documents in that regard have been annexed alongwith the communication of the Chief Judicial Magistrate, Aligarh.
Since the appellant no.1 has already died during the pendency of appeal, as such this appeal abates and is, accordingly, dismissed.
