The present appeal has been filed by the State against the judgment and order dated 20.07.1996 passed by 4th Additional Sessions Judge, Saharanpur in Criminal Appeal No. 59/94 (Hem Singh vs. State) and Criminal Appeal No. 61/94 (Prem Singh and another vs. State) by which the the respondents herein have been acquitted of the offence under Sections 323/34, 324/34 & 504 IPC.

The present appeal is reported to be beyond time by 4 days which has been filed on 26.10.1996. Since then, despite time being granted to the learned counsel for the State on five occasions, no delay condonation application has been filed as reported by the office vide its report dated 02.02.2023.

It has been 27 years since filing of this above mentioned appeal which is yet to see a delay condonation application of the State.

In view of the same, the appeal is consigned to records.
