This case has been taken up today itself on the urgency being expressed by Sri Gopal Pandey, learned counsel for the petitioners.

Heard learned counsel for the petitioners, learned Standing Counsel appearing on behalf of the respondents no. 1 & 2, Sri D.K.Singh Chauhan, learned counsel appearing on behalf of the respondent no. 4 and Sri Ravi Singh, learned counsel appearing on behalf of the respondent no. 3.

With the consent of learned counsel appearing for the contesting parties, the writ petition is being finally decided.

There is consensus at bar that the matter in issue is squarely covered by the judgment of this Court passed in Writ-C No. 10851 of 2023 Inre; Vardan Institute Of Pharmacy, Unnao Thru. Manager/ Trustee Prasoon Dixit And Anr Vs. State of U.P and Ors, decided on 14.12.2023.

Accordingly taking into consideration the aforesaid consensus, the present petition is disposed of in light of the aforesaid judgment passed in the case of Vardan Institute Of Pharmacy, Unnao (supra).

It is provided that the petitioners would also be entitled for the benefit of the judgment of Vardan Institute Of Pharmacy, Unnao (supra).

Let certified copy of this order be provided to the learned counsel for the parties today itself on payment of usual charges.
