This appeal has been filed by the State against the judgment and order dated27.05.2002, passed by learned Sessions Jude, Sitapur in S.T. No.954 of 1997, arising out of Crime No.144/1995, under Sections 308,323, 504, 506 IPC, P.S. Hargaon, District Sitapur, by which the learned trial court has acquitted respondent - Bhagwandeen for the offence under Section 307 I.P.C.
We have perused the record.
There is a report of Chief Judicial Magistrate, Sitapur dated 14.09.2023, which shows that the respondent Bhagwandeen has died 05 years back. The Court has examined the family members of respondent, Village Pradhan, Process Server and Sub Inspector of the police station concerned, who have corroborated the fact that the sole respondent Bhagwandeen has died.
Since the sole respondent has died, therefore, the appeal stands abated for deceased respondent.
