Heard Shri Arvind Pratap Singh, learned counsel for the petitioner and Shri S.B. Pandey, learned Assistant Solicitor General of India assisted by Shri Varun Pandey, learned counsel for the Union of India.
Petitioner seeks renewal of his passport, however, there is some criminal case pending against him. The petitioner is said to be residing out of country at the moment. Even if it is so, the remedy is before the Court where trial is pending and if the petitioner himself can not apply to the said Court his wife can do so in view of the decision dated 03.12.2022 passed in Writ - C No. 8621 of 2022; Shiv Shankar Vs. Union of India and Ors. and earlier decision on the subject in the case of Salim Khan Vs. Union of India and Ors.; Writ Petition No. 31723 (M/B) of 2018 dated 20.11.2018 and judgment dated 21.06.2022 rendered in Writ - C No. 3617 of 2022; Smt. Rashmi Kapoor Vs. Union of India and Ors.
With the aforesaid observations and liberty, the writ petition is disposed of.
