Heard learned counsel for the petitioner, learned Counsel for the State and Shri Shobhit Mohan Shukla, learned counsel representing the Uttar Pradesh Real Estate Regulatory Authority.

By filing this petition a prayer has been made to issue an appropriate direction to execute the Recovery Certificate issued by the Real Estate Regulatory Authority on 04.04.2022.

It appears that on some complaint an order was passed on 02.12.2021 by the Real Estate Regulatory Authority for execution of which a Recovery Certificate has been issued on 04.04.2022.

Submission of learned counsel for the petitioner is that the Recovery Certificate issued by the Real Estate Regulatory Authority has not been executed because of which the petitioner is deprived of the amount arising out of the judgment and order dated 02.12.2021 passed by the Real Estate Regulatory Authority. It has been stated by the learned counsel for the petitioner orally that the judgment and order dated 02.12.2021 has not been challenged in any other forum or court.

Accordingly, having regard to the aforementioned facts of the case, the writ petition is disposed of with direction to the District Magistrate concerned to execute the Recovery Certificate dated 04.04.2022 in its totality, with expedition, say within a period of four months from the date of production of a certified copy of this order, if there is no other legal impediment.
