1. Heard Sri Pankaj Bharti, learned counsel for revisionist and learned AGA for State.
2. This criminal revision under Section 397/401 Cr.P.C. has been filed aggrieved by judgment and order dated 10.09.2004 passed by Additional Sessions Judge, Fast Track Court No. 4, Muzaffar Nagar, acquitting Opposite Party No. 1 in Session Trial No. 1240 of 2002, under Sections 363, 366 IPC.
3. In the limited jurisdiction of revision this Court proceed to consider the impugned order of acquittal. Trial Court after considering the evidence has taken a possible view that allegation of abduction of one, Meenu alias Archana by accused, Manoj, was not proved beyond reasonable doubt as the girl has stated that she had went alongwith accused on her own sweet will and stayed as husband and wife. The said possible view is based on material available and having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in in revisional jurisdiction.
4. Revision is accordingly dismissed.
5. Certify this judgment to the lower Court immediately.
