Heard learned counsel for the petitioners and learned counsel for the respondent.

By means of this petition, petitioners have prayed for a direction upon the court below i.e. Principal Family Judge, Allahabad to decide the recall/restoration application for recall of the ex-parte judgment and decree dated 02.09.2021 passed in Partition Suit No. 297 of 2018 (Asha Merchant Pvt. Ltd. Vs. Smt. Asha Devi & others), within stipulated period.

In the present case, admittedly the said application is pending since 25.08.2022.

In view thereof, concerned Court is required to decide the said application of the petitioners, after hearing all the parties concerned, as expeditiously as possible, without any further delay. The court shall not fix a date in the matter more than a week and it shall not grant any unnecessary adjournment including the ground of strikes of the lawyers.

With the aforesaid observations, the petition is disposed of.
