Sri S.B. Maurya, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Ram Swaroop against the judgment and order dated 11.11.2005 passed by Additional District and Sessions Judge, Court No. 7, Mathura in Sessions Trial No. 545 of 1994, Police Station Brindavan, District Mathura.

As per office report dated 14.10.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 13.04.2022 informed that the appellant-Ram Swaroop has died on 01.01.2008. In support of which a report of concerned police station and the copy of death certificate issued by Government of Uttar Pradesh and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
