1. Shri Ashish Kumar, Advocate holding brief of Shri Anubhav Shukla, learned counsel for the applicant after arguing for sometime on instructions submits that he is not pressing the prayers made in this application for quashing the charge-sheet dated 20.06.2021 as well as cognizance order dated 21.09.2021 passed by Judicial Magistrate, Baheri, Bareilly in Case No. 1297 of 2021 in Charge Sheet No. 120 of 2021 (State Vs. Prem Shankar and Others), arising out of Case Crime No. 243 of 2020, under Sections 332, 353, 352, 504, 506 I.P.C., Police Station Sheeshgarh, District Bareilly and prayed that the applicant is desirous to appear before the trial court within a period of three weeks, file bail application and in case the bail application is filed, the same may be decided expeditiously in view of the judgment of Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.

2. In view of the above, prayers made in this application are rejected.

3. Application is disposed of with the direction that in the event applicant honour his undertaking and files appropriate bail application, Trial Court will undertake all endeavour to decide the same expeditiously in accordance with law considering the judgment passed by Supreme Court in Satender Kumar Antil (supra).
