Sri Ankit Srivastava, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Natthu Khan against the judgment and order dated 20.12.1984 passed by IV Additional Sessions Judge, Pilibhit in Sessions Trial No. 63 of 1984, Police Station Bhojipur, District Bareilly.

As per office report dated 15.10.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 23.09.2022 informed that the appellant-Natthu Khan has died 6-7 years ago. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
