HIGH COURT OF JUDICATURE AT ALLAHABAD Chief Justice's Court Serial No. 8 HIGH COURT OF JUDICATURE AT ALLAHABAD *** WRIT - C No. - 3861 of 2022 Rajendra Singh and others .....Petitioners v/s State of U.P. and others .....Respondents Through :- Mr. Jagdish Pathak, Standing Counsel for respondents no. 1 and 2, Ms. Ishita Sand, Advocate, holding brief of Ms. Anjali Upadhya, Advocate for respondent no. 3 CORAM : HON'BLE RAJESH BINDAL, CHIEF JUSTICE HON'BLE J.J. MUNIR, JUDGE ORDER 1. The case was taken up twice. No one has appeared for the petitioners. Earlier also, the position was same. 2. Learned counsel for the respondents submitted that the relief sought by the petitioners in the present petition is in the terms of the Full Bench judgment of this Court in Gajraj and others Vs. State of U.P. and others (2011) 11 ADJ 1. However, the petitioners were not parties in the earlier litigation before this Court, though the notification was considered. It is submitted that the issue raised in the present petition is squarely covered by the earlier order dated December 20, 2021 passed by this Court in Writ-C No. 33770 of 2021 (Jagveer and others Vs. State of U.P. and others). 3. Prima facie, we find the argument of learned counsel for the respondents to be meritorious. However, as the counsel for petitioners is not present, the writ petition is dismissed for non prosecution. (J.J. Munir, J.) (Rajesh Bindal, C.J.)
