HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH ?Court No. - 12 Case :- CRIMINAL REVISION No. - 458 of 2007 Revisionist :- Manglesh Kumar Opposite Party :- State Of U.P.And 2 Ors. Counsel for Revisionist :- J.K.Verma Counsel for Opposite Party :- Govt.Advocate,Ratnesh Trivedi Hon'ble Dinesh Kumar Singh,J.
1. Present revision has been filed against the judgment and order dated 13.07.2007 passed by Addl Sessions Judge/Court No. 2, Lakhimpur Kheri in Case Crime No.593 of 2003 under Sections 304, 506 IPC.
2. Trial Court after considering the facts, evidence and submission as well as defence did not find the charge under Section 304 and 506 IPC proved against the accused-respondents beyond reasonable doubt and, therefore, the Trial Court acquitted the accused-respondents in the aforesaid case.
3. I have perused the impugned judgment and order of the learned trial Court.
4. I do not find that the learned trial Court has committed any error of fact, evidence or law while passing the impugned judgment and order dated 13.07.2007. The incident is dated 03.08.2003. Almost 19 years have gone by since the date of incident. Even otherwise, it would not be proper to remand the case for retrial and, therefore, at this distant point of time, this Court does not find it to be a fit case for interference in exercise of revisional power under Section 397/401 Cr.P.C.
5. Thus, this revision being devoid of merit and substance is hereby dismissed.
(Dinesh Kumar Singh, J.)
