1. Present criminal revision has been directed against the judgment and order dated 21.11.2007 passed by Special Judge/Gangsters Act, Faizabad, Ayodhya in Crl Misc. Case Nos.76 of 2006, 78 of 2006, 77 of 2006.
2. Learned Special Judge/ Gangsters Act after analyzing the evidence brought on record by the prosecution and the defence held that there was no evidence on record to show that the land was purchased by the applicant with the aid of illegal earning and there was no evidence to show that he could spend the money in constructing the house in respect of illegal earnings.
3. Learned Special Judge came to the conclusion that the respondents have sufficiently shown the land attached was inherited from their ancestor and, thus attachment was cancelled and the property in question was released in favour of the respondents. This judgment was passed in the year 2007. Revision came to be filed in the year 2008. There has been no interim order in favour of the State.
4. Considering the aforesaid fact and circumstances of the case, this Court does not find that there is any error of jurisdiction or law or evidence in passing the impugned judgment and order by learned Special Judge/Gangsters Act and, therefore, this revision filed by the State fails which is hereby dismissed.
